1. Acceptance of Terms

By accessing or using the 0xKeep interface (the "Site") and the underlying smart contracts (the "Protocol"), you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Protocol. 0xKeep is a decentralized application running on various blockchains (Base, Arbitrum, Optimism). We do not control the blockchains and cannot reverse transactions.

2. Non-Custodial Nature

CRITICAL: 0xKeep is a non-custodial protocol. We do not hold your private keys, and we do not have possession of your assets.

The smart contracts are immutable and automated. Once assets are locked, they can only be withdrawn by the designated wallet address after the unlock timestamp has passed.

  • We cannot recover funds sent to the wrong address.
  • We cannot unlock funds before the designated time.
  • We cannot bypass lost private keys.

3. Fees and Payments

The Protocol charges a flat fee (payable in ETH) for creating locks or vesting schedules. These fees are hardcoded into the smart contract and are paid directly to the protocol at the moment of transaction execution. Fees are non-refundable under any circumstances, including but not limited to: user error, network congestion, or dissatisfaction with the service.

4. User Responsibilities

You represent and warrant that you are knowledgeable in blockchain technology and understand the risks associated with smart contracts. You agree NOT to use the Protocol for:

  • Any illegal activity, including money laundering or financing terrorism.
  • Locking tokens that have malicious functionality (e.g., honeypots, hidden mints).
  • Interacting with the Protocol from a jurisdiction where such interaction is prohibited.

5. Disclaimer of Warranties

THE SITE AND PROTOCOL ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE PROTOCOL WILL BE ERROR-FREE OR SECURE. YOU ASSUME ALL RISKS ASSOCIATED WITH USING THE SMART CONTRACTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 0XKEEP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PROTOCOL; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PROTOCOL; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
